The former director of the Beverly Public Library who pleaded guilty to possessing child pornography continues to fight for his public pension.
Thomas Scully has appealed a district court's judge's order last month revoking his pension to a Superior Court judge. A hearing has not been scheduled.
The Beverly retirement board approved Scully's request for a pension in 2005, shortly after his resignation, aware of the pending charges. His lawyer told The Salem News the decision can't be undone despite his subsequent conviction.
The appeal also claims that the decision to rescind Scully's pension came without any hearing, notice or "opportunity to be heard afforded to the plaintiff and violates due process."
