NH AG: Not enough evidence to prosecute death

CONCORD, N.H. (FOX 25 / MyFoxBoston.com) - New Hampshire's attorney general says there's not enough evidence to look into prosecuting someone in the case of a 10-year-old Massachusetts boy who was found dead in 2003 in the White Mountains.

Attorney General Michael Delaney was briefed on the case of Patric McCarthy last fall, when he took over as the state's top prosecutor.

The boy from Cape Cod was reported missing while vacationing with his family in Lincoln, and was found dead four days later after an extensive search. An autopsy concluded Patric died of hypothermia. His family has long doubted that and has tried to get prosecutors to reopen the case as a homicide investigation.

Delaney says if additional, credible evidence is found, his office will conduct a further review.
