Gun toting teen to stand trial on misdemeanor charges

An Oakland county teen will stand trial on misdemeanor charges after police say he resisted arrest while carrying a firearm in downtown Birmingham.
Judge Marc Barron of 48th District Court made his ruling Wednesday. Sean M. Combs was arrested in April when police say the 18-year-old Troy High School student walked down Old Woodward Ave. in Birmingham with a M-1 rifle strapped to his back.
Combs is charged with violating local Birmingham ordinances, disorderly conduct, resisting arrest and openly carrying a gun.
"State law is pretty clear about carrying open firearms, the disturbing the peace was another issue," said Combs' attorney. "They're claiming my client was disturbing the peace, and it's our position that there was no peace being disturbed until the police approached my client."
Although Combs' attorney thinks his client was within his legal rights, Judge Barron said, "this is not a guns rights case."
Suspected gun advocates and supporters of Michigan's open carry law didn't show up in support of Combs, who said, "I was just minding my own business, carrying my firearm."
A jury will make the final decision of this case next month.
