Defense claims Nicolas Guaman is mentally incompetent

WORCESTER (FOX 25 / MyFoxBoston.com) - An attorney representing Nicolas Guaman, the illegal immigrant accused of killing a Milford man in a car accident, claims his client is mentally incompetent to stand trial.

Guaman and his lawyer appeared in court on Tuesday for a pretrial hearing and told the judge that he could provide an expert who would testify that his client can not stand trial because he is mentally incompetent, reports Milford Patch.

Guaman, 34, is facing multiple charges for the Aug. 20, 2011 death of 23-year-old Matthew Denice.  Guaman reportedly struck the victim with his pick-up truck and continued driving after the crash despite witnesses banging on the driver's door and attempting to alert him that Denice was trapped under the truck.

According to the site, the expert was reportedly paid for by the defense, and the district attorney noted that prosecutors have yet to hire their own medical expert to examine Guaman.  He will appear in court on Wednesday for a hearing that will include the state's evaluation, as well as court depositions of four members of the Guaman family.

Prior to the fatal crash, Guaman, originally from Ecuador, was arrested several times in Massachusetts.
