Race and pre-conceptions are concerns in Kwame jury pool

SOUTHFIELD, Mich. (MyFoxDetroit) -

Federal prosecutors have an ace up their sleeve. He's Richard Gabriel, a jury consultant from L.A. who worked on the O.J. Simpson case.

He's here for one reason: "Obviously everyone's trying to find a fair and impartial jury," he says.

Both sides differ on who makes a good juror but they all agree it's one of the most important phases of the trial.

"You are involved in choosing who the decision-makers are going to be in your client's case," says the attorney for Bernard Kilpatrick, John Shea.

A new line of defense questioning emerged today, concerned over racial language presumably uttered by defendants caught on wire-tap. Shea declined to provide specifics.

"Everybody anticipates there will be some evidence that has race related language, maybe racially charged language, but that's as far as I'm going to go. That's going to be evidence and I'm not going to talk about it," Shae told us.

Kwame Kilpatrick was lighthearted on his way out of court, kidding with the cameraman.

He warns, "Watch yourself!" as the cameraman bumps into a parked vehicle. After asking if he was okay, Kilpatrick jokes, "They'll swear I did something."
