Shawn Drumgold cleared of drug charges

BOSTON (FOX 25 / MyFoxBoston.com) - A man who spent 15 years in prison after being wrongfully convicted in the killing of a 12-year-old girl has been cleared of unrelated drug charges.

A Roxbury District Court judge acquitted Shawn Drumgold on Friday.

Drumgold's attorney argued that prosecutors had not shown that her client possessed the heroin and cocaine found in a Roxbury apartment. She also argued that evidence in his case could have been tainted by a chemist at the center of a testing scandal at a state lab. Annie Dookhan has been charged with obstruction of justice for allegedly skirting lab protocols and faking test results at the now-closed lab.

A spokesman for Suffolk District Attorney Dan Conley says the judge's decision to acquit Drumgold was based on prosecutors' theory of possession, not on the lab scandal.
