NORTHAMPTON, Mass. (AP) - Defense attorneys for a Northampton man charged
with setting a fatal fire in the city three years ago have asked a judge to
dismiss the case, saying the grand jury that indicted their client was given
"shoddy merchandise" by the state.
Lawyers for Anthony Baye said in their motion that "improper evidence
was knowingly given to the grand jury in order to obtain the indictment."
The 28-year-old Baye is charged with setting a series of fires in the early
morning of Dec. 29, 2009, including one that killed 81-year-old Paul Yeskie Sr.
and 39-year-old Paul Yeskie Jr.
The Daily Hampshire Gazette (http://bit.ly/UYXtU0)
reports that the motion to dismiss says there's no probable cause to link Baye
to the fires.
Prosecutors say they are in the process of reviewing the motion.
