Lawsuit dismissed in case of teen who fell from plane

MILTON, Mass. – A lawsuit filed by the family of a teen who fell from a plane's wheel well in 2010 has been dismissed.

The mutilated body of Delvonte Tisdale, of Charlotte, N.C., was found on a quiet Milton street in Nov. 2010. Investigators said Tisdale climbed into the wheel well of a Boston-bound Boeing 737 at Charlotte Douglas International Airport . His body was dropped as the plane's landing gear was deployed near Logan International Airport.

Tisdale's family sued the city of Charlotte, Charlotte Douglas International Airport and US Airways for negligence, claiming that more should have been done to prevent Tisdale from getting onto the tarmac and into the plane.

WCNC.com reported that a superior court judge ruled that there was no evidence the city, airport or US Airways did anything wrong and that Tisdale was negligent for entering a secured area.

In response to the verdict, a spokesman for the City of Charlotte said, "While the City remains saddened by Mr. Tisdale's death and sympathizes with his family, the Court's ruling confirms our belief that the City should not be held legally liable for Mr. Tisdale's decisions and actions."

Tisdale's family can appeal the decision.
