(MyFoxBoston.com) –  The criminal case against the brother of an illegal immigrant charged in a deadly drunk driving crash is being dropped.

Pablo Guaman was facing a misdemeanor charge. He was accused of allowing his unlicensed brother to drive his truck.

Nicolas Guaman is charged with second-degree murder. Police say he was drunk when he hit and killed Matthew Denice of Milford, in August of 2011.

Nicolas Guaman is due back in court on March 29. That's when a judge may decide if he is competent to stand trial.

Pablo Guaman was recently questioned under oath by prosecutors and his brother's defense attorney.
