Elizabeth Petrakis, 39, was able to convince an appellate panel to toss out the pre-nuptial agreement she signed with millionaire Peter Petrakis, 41, four days before her 1998 wedding.

Legal experts say the case has huge implications for married couples who have signed pre-nuptial agreements.

Petrakis' husband, according to Elizabeth, had made several promises to throw out the pre-nup before and during their marriage.

"Six weeks before (we married) he asked me to sign it. I said yes four days before the wedding. I had a lawyer look at it who said 'do not sign it.' He promised me that once we had children we're throwing it out," said Petrakis.

The marriage began to unravel in 2002 and the pair have been estranged for seven years.

"This was fraud. Six judges have agreed," Petrakis told Good Day NY.

Peter Petrakis, Elizabeth's husband, is reportedly considering an appeal.

"He's a good guy. May be it was the lawyers who pushed him."
