PLYMOUTH, N.H. (AP) — The 22-year-old son of Boston's Police Commissioner is scheduled to make his first appearance in a New Hampshire courtroom on a charge of operating under the influence.

Phillip Davis was arrested by New Hampshire State Police Feb. 17 and charged with driving under the influence. Five passengers in his car — all under the age of 21 — were charged with possession of alcohol by a minor.

Police Commissioner Ed Davis has been a prominent figure the Boston Marathon bombings investigation.

He issued a statement on the Boston Police Department's website after his son's arrest, saying his son is seeking treatment and he is thankful no one was hurt in the incident.

Plymouth court officials say no lawyer has filed an appearance in Davis's case. He's scheduled in court Thursday.
