Cape Cod woman accused of stealing from charity found guilty

BARNSTABLE, Mass. (MyFoxBoston.com) – A Marston Mills woman accused of stealing thousands of dollars from Touched by Angels was convicted on more than 50 counts of embezzlement Thursday afternoon.

The verdict comes after a 17-day trial.

Gina Clark, 42, the founder of a Cape Cod charity that was organized to provide financial assistance for families who lost loved ones or were dealing with serious medical situations was found guilty of stealing tens of thousands of dollars for personal use.

In total, the defendant and her organization were found guilty on 52 counts, including fair labor violations and for operating an illegal lottery scheme.

From October 2007 through August 2010, Clark operated Touched By Angels (TBA), a non-profit charity, and promised to raise funds on behalf of deserving families, selected by TBA usually for a one month period each.

An investigation into the organization began after two former employees told authorities that Clark was not giving the designated amount of proceeds to these families.

Investigators found that Clark defrauded over a dozen families out of tens of thousands of dollars and was in violation of numerous other codes.

In 2010, Clark was ordered to disband her organization and cease all solicitation activities because of multiple complaints regarding the misuse of funds and solicitation methods.

A jury returned indictments against both Clark and her organization on March 25, 2011. They were arraigned on May 5, 2011 and found guilty May 2, 2013.

A sentencing hearing for the defendants is set to begin on May 6.
