ICE lodges detainers against Tsarnaev's Kazakh friends

BOSTON (MyFoxBoston.com) -- U.S. Immigration and Customs Enforcement has temporarily closed their court proceedings against two friends of marathon bombing suspect Dzhokhar Tsarnaev.

ICE officials say the agency lodged detainers against Dias Kadyrbayev and Azamat Tazhayakov and they plan to continue the immigration removal process once criminal charges are adjudicated.

Kadyrbayev and Tazhayakov, natives of Kazakhstan, are charged with conspiring to destroy emptied fireworks and other evidence linking their friend to the deadly April 15 blasts.

Investigators allege Kadyrbayev text messaged 19-year-old Dzhokhar Tsarnaev on April 18 saying that he looked like one of the bombing suspects. Tsarnaev responded by saying, "lol," as well as "you better not text me" and "come to my room and take whatever you want."

Kadyrbayev went to Tsarnaev's UMass Dartmouth dorm room along with Tazhayakov and Cambridge native Robel Phillipos. The men are accused of removing a backpack and laptop from the room and later throwing it in the garbage. The bag, which contained empty fireworks, was recovered by investigators in a landfill.

Phillipos is accused of lying to investigators about the visit to Tsarnaev's dorm room. He was released Monday under the conditions that he remain at home and wear a GPS monitoring device.

The Tsarnaev brothers are accused of fatally shooting MIT police officer Sean Collier on the night of April 18. They then carjacked a Cambridge man, ending up in a shootout with police in East Watertown. Tamerlan Tsarnaev, 26, died after the shootout. Police say Dzhokhar drove over his brother as he fled the area. The younger Tsarnaev was found hours later hiding in a resident's back yard.

Dzhokhar Tsarnaev is being held at FMC Devens. A Worcester funeral home is searching for a burial plot for his brother.
