DETROIT (WJBK) -

While on trial with his buddy Kwame Kilpatrick, Bobby Fergeson had plenty of lawyers.

Now that he is facing a retrial on bid-rigging charges in a separate case, Ferguson may have to represent himself. That's because Fergeson claims he's broke, and while he wants a court appointed attorney, he refuses to fill out an application the feds need to determine if he qualifies for a taxpayer funded lawyer.

"If you don't sign an affidavit and demonstrate that you're indigent, then you're not allowed to have an assigned attorney," said David Steingold, attorney for Ferguson Enterprises. "For reasons that I cannot discuss, he is not prepared and I don't believe will ever sign the affidavit."

A magistrate told Fergeson he now has only two options, represent himself or find a lawyer on his own.

Fergeson will be back in court on Thursday to learn what happens next.
