Bulger judge allows criminal background checks for potential jurors

BOSTON (MyFoxBoston.com) -- The judge presiding over the trial of reputed mob boss James "Whitey" Bulger has granted the government's request to conduct criminal background checks on potential jurors.

Judge Denise J. Casper ruled in favor of the motion under the condition that the checks are only on potential jurors who remain in the jury pool after the initial review of their juror questionnaires on June 5, one day before the trial is set to begin. The government must share the sealed results of their checks with Bulger's attorneys and both sides must keep the results confidential.

According to Judge Casper's order issued Friday, Bulger objected to the checks, claiming there is no federal law mandating such verification. She states, however, there is no compelling reason not to conduct the checks and cites both parties in saying that the trial will take several months and substantial effort from both the counsel and the jurors.
