ORLEANS, Mass. (AP) — A driver charged with striking and killing a man waiting for a bus and injuring a family of four in their vehicle as he allegedly fled police on Cape Cod has been ordered held without bail for 90 days.
A judge in Orleans District Court at a dangerousness hearing Monday agreed with the prosecutor that 31-year-old Benjamin Shealey showed a disregard for public safety that made him a public danger for his alleged actions on July 13.
The Cape Cod Times (http://bit.ly/11bvTXL ) reports that Shealey's lawyer told the judge that her client should be released on bail because he has the support of his family, would submit to GPS monitoring and take public transportation to work.
Shealey has pleaded not guilty to charges including motor vehicle homicide and drunken driving.
