Judge denies Kilpatrick, Ferguson's request for new trial

Former Detroit Mayor Kwame Kilpatrick, Bernard Kilpatrick and Bobby Ferguson lost their argument in court today to be given a new trial.

In March, a jury convicted Kwame Kilpatrick and former city contractor Bobby Ferguson of racketeering, bribery and other charges. The two men are awaiting sentencing at a federal prison in Milan and each of them likely face 20-30 years in federal prison.

Bernard Kilpatrick, Kwame's father, was convicted on a single charge of tax fraud. He is free on bond while he awaits his sentence.

All three men were seeking a new trial.

On Thursday, Kilpatrick and his newly appointed lawyer Harold Gurewitz, argued that Kilpatrick did not receive a fair trial.

Kilpatrick claimed he was denied his Sixth Amendment right to effective legal council, saying attorney Jim Thomas had a conflict of interest while representing him.

Ferguson claimed prosecutors failed to prove their case and that he was denied his constitutional right to a fair trial as a result of 'inflammatory and prejudicial remarks' during closing arguments.

On Thursday a judge rebuked the argument and shot down a chance at a new trial.  An appeal of the outcome of the first trial is pending, which is a different matter than what today's hearing addressed.

Sentencing for the three men is scheduled for September 3rd.
