Does this 2nd Amendment protest go too far?

Posted: Updated:
LAKE ORION, Mich. (WJBK) -

Nicholas Somberg stages what are called 'For Liberty Fridays.'  He stands by the side of the road, sometimes with others based on the Facebook page comments and photos, holding signs that read 'Don't Tread on Me', 'End the Fed' and the like.

The protest often happens at the corner of Maybee and Baldwin Road in Lake Orion.

Sometimes he holds a rifle with a sign. Last week this caused a confrontation with the Oakland County Sheriff's Department.

As Somberg walked around with a rifle, someone called 911.

When the Oakland County Sheriff's Department arrived, Somber and the deputy exchanged words.  Somber recorded the whole event on video and posted it to YouTube.  You can see the video embedded in this story.

Somber was told to put down his weapon after the deputy felt the gun was pointed in his direction.  The video captures the conversation between the men as well as the arrival of several other Oakland County Sheriff Deputies.

Somberg is confrontational, uses swear words and attempts to evoke his 2nd, 1st and 5th amendment rights.

In the dispute with the deputies, Somber's rifle was confiscated but later returned.

Play the videos in this story to see Andrea Isom's report as she gets reaction from the Oakland County Undersheriff Mike McCabe and talks to Somberg about the event in question. Play the YouTube video taken by Somberg to get a sense of what went on that day.

Here are some questions:

What would you think or do if someone in your neighborhood walked around their yard with a rifle?

What would think or do if you were driving on a street and someone had a rifle strapped around their body waving signs?

Given all that has happened with shootings lately, including a Michigan State Trooper being killed on the west side of the state and of course the shootings at the Naval Yard in Washington DC, do you think there's a better way to exercise a belief in the Second Amendment?

Do you think Somberg is within his rights?  Do you think Somberg is out of line? Do you think both?  Add your thoughts to the bottom of this story.

Amendment II

A well regulated militia, being necessary to the security of a free state, the right of the people to keep and bear arms, shall not be infringed.
