Inmate connected to lab scandal has sentence cut

Posted: Updated:

BOSTON (AP) — A federal judge has reduced the sentence of a convicted drug dealer who argued that he should be freed because his classification as a career criminal was based in part on a state conviction connected to the Massachusetts drug testing lab scandal.

Adam Davila asked a judge Tuesday to change his sentence to time served, because the state conviction was vacated because of its connection to a state chemist who's charged with faking test results and tampering with evidence. Authorities have said the chemist's actions put thousands of criminal cases in jeopardy.

The Boston Globe (http://b.globe.com/187QYp7 ) reports that the judge instead reduced Davila's 10-year sentence to six years, meaning he still has three years to serve. The judge says Davila still has an extensive criminal history.
