2nd Grader Videotaped In Bathroom At Philadelphia School

"He's humiliated," said a mom who is hurting for her seven year old son. He's a second grader at B.B. Comegys School in Southwest Philadelphia. She says Monday the principal called her with some disturbing news.

"She stated that my son was using the bathroom and about two to three boys entered the bathroom and decided they were going to open his stall and videotape him while he was using the bathroom," said the mother. We're concealing her identity to protect her son. She says the boys who did this to him are seventh graders between 12 and 13 years old and that the incident got worse.

"They asked him could they look at his private area and could they look at his feces in the toilet. They thought it was a joke and bragged about putting it on the social media site Instagram," said the mother.

She was told a school administrator saw the boys coming out of the bathroom, stopped them and found out what had happened. Two days later, the mom says she is upset that no one will show her the cell phone video which she says the principal told her shows her son sitting on the toilet but not his genitals.

"The principal told me that it's in her vault and it's police property. But when I spoke with police they told me that they haven't seen the video and that there's no real criminal intent for them to criminally charge the boys so they don't have to ask to see the video. Now it's just like it's hearsay what happened to my son." The mother received a paper signed by the principal about the incident. It also states a report was filed with police.

Fox 29 went to the school but was first told the principal wasn't there. Then a district spokesperson said the principal doesn't want to comment.

The victim's distraught mother says she plans on transferring her son to another school but feels no one is taking what happened to him seriously.

"It could have been any child. It could have been a little girl or boy using the bathroom at that time and they just walked in there."

A school district spokesperson tells Fox 29 the older kids involved have been suspended but the victim's mother doesn't feel that's enough. She also says police told her even though her son was taped using the bathroom, if the video wasn't used as child pornography or actually downloaded anywhere there is no crime.
