Former Plymouth County ADA sues for wrongful termination

BOSTON (MyFoxBoston.com) -- Plymouth County District Attorney Timothy Cruz and other senior members in his office are being sued by a former employee.

According to papers filed in federal court last week, John Bradley is suing Cruz, Michael Horan, and Frank Middleton for Civil Rights violations and wrongful termination. Bradley was a deputy first assistant district attorney. The claims he has made are violations of the Massachusetts Whistle Blower Statute.

In court documents, Bradley says he maintained a cordial relationship with the senior leadership in the district attorney's office up until he chose not to contribute to Cruz's re-election bid in 2010. The former ADA alleges leadership threatened that those who did not make financial contributions "should proceed at their own peril, or words to that effect."

Bradley accuses Cruz of "angrily" calling him into his office once and telling him that it was "not his job to involve himself in public policy matters" after he was mentioned in a Boston Globe series on high acquittal rates in jury-waived OUI cases.

In the lawsuit, Bradley claims he was called into Horan's office and asked to resign on Sept. 28, 2012. When he refused, he was terminated. He claims Horan said, "Of course not," when asked if he would be provided with a reason for his termination.

The district attorney's office released the following statement:

"There are numerous falsehoods and inaccuracies in this complaint, which was filed by a former disgruntled employee terminated by the DA's office. All of the defendants look forward to defending themselves vigorously in court. We will have no additional comment at this time since the matter is in active litigation."
