Posted: Updated:

It's a place where kids go to learn but one 4th-grader says behind these walls says he's being terrorized.

A student says, "he came up and pushed me, I pushed him back and he punched me in the face and he said haha, you got punched."

This 9 year old says he's a victim of bullying. Here at rolling hills elementary school in Fairfield CA.

The 4thgrader says, "he uses the n-word many times, b word, the s-word."

The Fuedner family is fuming saying the harassment has gone on for 5 months and the school isn't stopping it.

That's why the fourth graders dad says he had no choice but to go for a restraining order against a 9-years-old boy.

The child's father, Stephen, Fuedner says "I am trying to protect them from future attack by this young man."

Stephen Fuedner only has a first name of the child. He doesn't know the last name because he says the school won't release it.

Fuedner claims, "they told me it's confidential information."

Fox reached out to the Fairrfield-Suisun Unified School District.

The school responded "they know mister Fuedner wanted the alleged bully's information but the school district can't hand it over because it's confidential. "
